Behaviour Support and Therapy Privacy Collection Statement
Behaviour Support and Therapy is committed to ensuring the privacy of personal information gathered about our clients and their families by complying with the Australian Privacy Principles and the Commonwealth Privacy Act 1988 dealing with the collection, use, disclosure and data security of personal information.
In order to deliver safe and high quality services to its clients, Behaviour Support and Therapy collects and holds personal information and sensitive personal information. People have the right to know what information is collected about them, how that information is collected and stored, who has access to the information and to whom it may be disclosed.
- Personal information that we collect and hold
- We collect personal information and sensitive information from our clients.
- Personal information is defined in the Privacy Act to mean information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether true or not.
- Sensible information is defined in the Privacy Act to include information about an individual’s health, genetic or biometric information. Further information and a full definition can be found on the website of the Office of the Australian Information Commissioner.
- The types of personal information and sensitive information we typically collect includes:
- Name, address, telephone number, email address and any other necessary or required contact information;
- Gender, marital status, guardian details, or any relevant custody details;
- Emergency contact information;
- Details of the individual’s school, care facility, family doctor, or any other relevant health professional;
- Sensitive information on the health, sex or abilities of the individual;
- Details about health and/or disabilities services accessed.
- How Behaviour Support and Therapy collects and holds personal information
- Behaviour Support and Therapy collects information that is required to provide services and our relevant obligations and duties.
- Behaviour Support and Therapy will generally only collect personal information about from other sources with an individual’s consent, or if required by law.
- Behaviour Support and Therapy will only collect information in a fair, non-intrusive and lawful way. Where possible, this information will be collected directly from the individual rather than from others.
- Data Security
- Behaviour Support and Therapy takes reasonable steps to protect the personal information it holds as online data from misuse and loss, unauthorised access, disclosure or modification.
- If an individual’s personal information had been accessed by an unauthorised party (or where we suspected that it had), we would tell that individual and take appropriate steps to reduce the risk of harm. This might include notifying the Office of the Australian Information Commissioner of a data breach.
- If we breach a client’s privacy or confidentiality we will manage that
- The purposes for which Behaviour Support and Therapy collects, holds, uses and discloses personal information.
- Behaviour Support and Therapy uses or discloses the personal information for individuals for the purpose for which it was collected, or is related to the primary purpose. Personal information is collected primarily for the following purposes:
- Provision of therapy, support and support coordination services;
- Assessment and reporting purposes;
- State, federal and regulatory audits; and
- Training and induction of our employees and students.
- The exception to this is where personal information is required to be disclosed to external organisations or bodies by law. This would include, for example, mandatory reporting obligations in relation to child abuse.
- Behaviour Support and Therapy uses or discloses the personal information for individuals for the purpose for which it was collected, or is related to the primary purpose. Personal information is collected primarily for the following purposes:
- Accuracy of Information
Behaviour Support and Therapy will take reasonable steps to ensure the accuracy and completeness of the personal information collected, used or disclosed. Wherever possible and reasonable, steps will be taken to ensure information is current and to correct incomplete, inaccurate or outdated personal information.
- How an individual may access personal information about the individual that is held by Behaviour Support and Therapy and seek the correction of such information.
Individuals have the right to access and seek correction of personal information held by Behaviour Support and Therapy by contacting one of our offices within a reasonable timeframe. Personal information will only be withheld when required by law including, for example, where a Court has ordered that it not be disclosed.
- How an individual may complain about a breach of the Australia Privacy Principles, that bind Behaviour Support and Therapy, and how Behaviour Support and Therapy will deal with such a complaint.
- Individuals are encouraged to follow the Behaviour Support and Therapy complaints and feedback procedure if they have a complaint about the way in which their personal information is gathered, held and handled by contacting our office on (08) 7072 2566.
- If individuals are not satisfied with the handling of their complaint, or feel that the appropriate actions and steps were not made, we encourage individuals to contact the office of the Australian Information Commissioner on 1300 363 992 for further assistance.
- Whether Behaviour Support and Therapy is likely to disclose personal information to overseas recipients.
Behaviour Support and Therapy do not provide personal or sensitive information to overseas recipients.
- Anonymity and Pseudonymity
- Wherever it is lawful and practical, and in doing so, does not compromise the provision of services, Behaviour Support and Therapy provides individuals with the option of not identifying themselves, or of using a pseudonym when personal information is collected.
- Information Sharing Guidelines
- Behaviour Support and Therapy adheres to the South Australian Government Information Sharing Guidelines for Promoting Safety and Wellbeing. We work closely with other agencies to coordinate supports to provide the best quality, multidisciplinary service to the individual and their family.
- Consent will be sought from the individual and their family before personal information is shared between organisations, unless the following situations apply:
- It is unsafe or impossible for Behaviour Support and Therapy staff to gain consent, and/or consent has been refused and the below situation is true
- Without information being shared, the individual, a member of their family, or a member of the public will be at risk of serious harm, abuse or neglect, or they pose a risk to their own or the public’s safety.
- Transfer of Personal Information to Third Parties
- Written consent from the individual is needed prior to the release of information to any third parties. Requests can be made via email our enquiry form.
- Exceptions to this may apply when applying the Information Sharing Guidelines and the transfer of information is to facilitate service provision where there is a risk of harm to the individual, their family or the public.
- When transferring information, reasonable steps will be taken to maintain the security and privacy of the personal information that is being transferred.
- Website Privacy Policy
- Behaviour Support and Therapy does not collect or track personal information from its site visitors. Generic information from server logs may be used to track the number of hits to the site, and to find out what types of browser software are used by visitors. This information will be used only in aggregate form, and used solely for improving web site design. Information provided via the enquiry form is used solely to assist with fulfilling the user’s needs and is not sold to any 3rd parties or used in advertising or promotions.
Funding and need
We are committed to ensuring each of our clients receives an NDIS plan that matches their level of need and allows them to work positively towards actualising their NDIS goals. We are experienced in supporting clients to access the funding they need by:
- Assisting them to understand their rights to seek additional funding by applying for a review of their plan
- Ensuring that they are accessing all the funding lines that they are entitled to and getting value for money
- Identifying the interventions that clients need to their NDIS goals
- Ensuring that our clients have their voices heard (including by attending planning review meetings).
Our expertise and experience
We have 15 years of experience providing therapeutic services and behaviour management to clients of all ages with complex disability, mental health and dual diagnosis. We have a particular interest in infant mental health and disability. We have significant expertise in case managing clients with complex needs and circumstances.
We apply evidence-based interventions including Marte Meo, Cognitive Behavioural Therapy, Mindfulness based therapies, Trauma Informed Care, Interactional Video Analysis, Play Therapy, and Acceptance and Commitment Therapy.
Our therapeutic approach aims to provide clients with the tools to understand themselves and their relationships, empowering them to recognise and enhance their strengths, fulfil their potential and expand their horizons.
Behaviour Support and Therapy provides the same level of access to services and the same quality of services to all cultural and linguistic groups, including, but not limited to, Aboriginal and Torres Strait Islander people, culturally and linguistically diverse communities, people of all ages and people of diverse sexualities and gender identities.
